Daum, et al. v. Claim Jumper Restaurants
Mr. Daum worked for Claim Jumper restaurant as an Assistant Kitchen Manager, where he cooked, prepared food, took inventory and performed other similar kitchen tasks. Claim Jumper' s job description for the Assistant Kitchen Manager (AKM) called for a 55-hour work week. Mr. Daum was not paid overtime, nor were any of the other AKMs at the Claim Jumper chain of restaurants.
We filed a class action lawsuit alleging that Claim Jumper misclassified the AKMs as exempt from overtime laws and should pay for all overtime hours they work. In October 2004, we were successful in certifying the case as a class action. In August 2006, we reached a settlement with Claim Jumper on behalf of the 76 class members. In settling, Claim Jumper agreed to pay $6,500,000 and reclassify the AKM position so that it is not exempt from the laws regarding overtime. The settlement has been approved preliminarily by the Court. The hearing for final approval will take place in December.
